Q7

The main point of the passage is shown in two specific areas of the text in which the author asserts her opinion: "Trademark owners justifiably argue against gray marketing..." (26) and "I believe it is inevitable as well as desirable that [territoriality theory] will come to be consistently applied in gray marketing cases" (62-5).

Hence, we want to find something that speaks out AGAINST gray marketing and perhaps something that talks about "territoriality theory."

    (A) Looks pretty good! This certainly speaks well to the final sentence of the passage. However, I am on the lookout for something slightly better because I still think "territoriality theory" should be discussed.

    (B) Legislators should recognize the "futility?" No way! The author not only believes that regulating it is desirable but also she believes that it WILL become regulated in some way.

    (C) We certainly compared the grey marketing within vs. without markets, yet this wasn't really the main point of the text. Those two paragraphs at the beginning seemed to serve as background information. Also, we have no support for effectiveness of controlling gray marketing across vs. within markets. Eliminate.

    (D) This is absolutely true! But is it the main point? No, where is the author's opinion! The author is VERY opinionated and we should afford her some part in the correct answer.

    (E) Increased gray market activity? No support for this.

So (A) it is. I really thought some discussion about the theory that the author likes would be discussed but the message behind why the author likes that particularly theory is abundantly clear in (A). We'll go with it!
