E gets at the same trap comparison as Q16 choice A: we never contrast those two flavors of confession evidence. Instead, we use what's true about defendant confessions to draw a similar conclusion about witness confessions.
D says the passage questions the relevance of the jury process to the issue of courts relying on witness testimony. But the passage does the opposite! It argues for the relevance of this process, saying that because juries might give undue weight to this testimony, courts shouldn't rely on it anymore.
