Since it's looking into the future, it doesn't take into account the possibility that they pay off the loan by the end of the year. To address the specific question here, it's not necessary because they don't have to run into the trigger this year to get to the conclusion; they could fall below $1m next year, or last year, and still have to declare bankruptcy.

(E) Out of scope. While this would be nice for Acme, they do have the bank loan, so this answer choice doesn't apply to the situation at hand.
