This tells us that in the adversarial system, the crucial factor IS the legal rule. Note that the actual term "crucial factor," as used in the passage, also appears in the stem of the question.
The other four answer choices are just not quite right. There isn't the same kind of direct support for any of them in the passage, even if you could make an argument for them; the support is not going to be as direct.
