Q15

by denisel0807 Sun Jun 10, 2018 3:39 pm

I'm having a hard time understanding why B is the right answer and not E.

Both passages state that their fields are not effectively covered by current IP law and so I feel that answers B because it gives a reason why individuals in those fields wouldn't rely on legal protections.

Passage B also states that trade secrecy laws are potentially available and are seldom used but doesn't give an explanation. While that is true, it is immediately preceded by the challenges chefs face in IP battles. And so, I feel that those are good reasons why chefs would choose not to engage.

In defense of choice E, passage A explains the sanctions that occur when individuals don't follow the social norms but Passage B does not. Passage B does not at all discuss what is prohibitive about the social norms in place. It explains what chefs do but doesn't explain why anyone follows the rules, it doesn't explain the prohibitive nature of the rule system.

So, I'm having a tough time seeing how choice B goes unanswered by Passage B while E is.

(A) This is definitely answered in psg B, lines 56-59.

(B) Lines 9-13 provide a reason why comedians rarely choose to pursue a legal claim against another comedian.

For psg B, we don't get answers.
WHY do chefs seldom use legal protections via trade secrecy laws? Don't know.
We can't say "they don't use trade secrecy laws because most recipes are patentable and copyright law doesn't cover combinations of ingredients."
Copyright, patent, and trade secrecy are three different forms of law. It doesn't make sense to say "the fact that A-laws and B-laws barely cover or don't cover recipes is why chefs rarely use C-laws, which DO potentially offer legal protection."

(C) This is definitely discussed in psg B, line 43.

(D) This is discussed in both: jokes and recipes.

(E) This is discussed in both.

Both passages discuss the norms. Only psg A discusses the enforcement mechanisms, but this answer choice isn't asking "What are the consequences of violating social norms regarding violating the IP of other members of the group?"

It's just asking, "What social norms exist?"
Psg B definitely provides answers to that ... line 46 begins "Three implicit norms are operative among chefs" and then the second paragraph of psg B enumerates the three social norms "First ... a second norm mandates ... a third norm is ... "

The correct answer is (B). Hope this helps.
