P1: some N.A. (Native Americans) have struggled to get their land claims settled in course - this emphasized how different the cultures and their modes of discourse.

P2: Example of a N.A. land dispute: Town says Mashpee's are not tribe.

P3: More info about that example: Town say Mashpee have no written proof; N.A say oral proof is valid. Court ruled against Mashpee. While courts getting better at these cases as courts recognize that different culture's forms of discourse can complicate fairness.

It's tough to get a clear scale off this passage as it's mostly informational, pointing out how a struggle stems from a certain intercultural issue.

If you considered the scale to be Mashpee N.A. vs. Town, you would have missed the overarching point.
